What are your rights to pay from your employer?

We all understand that we are entitled to payment by an employer, but what actually are our legal rights?

Rights To Pay

All employees are entitled to be paid for work they have carried out, but they are also entitled to be paid if they are available for work and their employer is unable to provide them with any (unless your employment contract specifically covers this point).

You will also be entitled to be paid at time when you are unable to work including:

  • Off work due to sickness
  • Maternity leave
  • Paternity/Adoption leave
  • Parental leave
  • Paid holiday

The exact duration and amount of pay will depend on various factors, but there is a basic entitlement on each of these occasions.

How Much Pay Will You Receive?

There is a national minimum wage scheme which dictates the minimum amount of pay that nearly all workers should receive. However, it is a minimum amount of pay and workers may be entitled to more payment under their contract.

What is clear is that you should not be discriminated against in terms of payment due to your race, religion or sex.

How Should You Receive Your Payment?

There is no legal entitlement to receive pay in any certain format. How you are paid will be decided by your employer. Generally how you are paid is agreed between yourself and your employer.

Your Right To A Pay Slip

In addition to your right to payment, you are also entitled to receive a written pay slip which will detail:

  • Your gross pay (i.e. the total amount being paid to you);
  • The deductions from your salary (for example, for tax and national insurance);
  • The total amount of any fixed deductions (such as union fees);
  • The net pay (i.e. what you will actually receive)

Summary

You are entitled to payment which should at least be at the level of the national minimum wage, to time off paid in circumstances and to a pay slip detailing the payments you receive.
